Company Story
Brian G. Methner
Owner and Managing Attorney
Methner and Associates, P.C.
In college, Alex, a close family friend, had been embroiled in a legal battle with a business partner over land in Southern Colorado. Legal fees to defend the lawsuit mounted and debt from the suit loomed large on the horizon. I could feel the strain of the situation on Alex and felt compelled to help. I decided to go to law school and gain the skill necessary to defend the lawsuit.
I graduated from college a few years later. Alex’s lawsuit and issues had faded. Family had stepped in and he was able to hold onto his life and property. I decided to explore my interests in finance instead of going directly to law school and became a stock broker. For almost two years I worked at a major brokerage firm helping people with investments. In the back of my mind I remembered Alex’s plight, felt there was more that I could be doing to help people, and enrolled at the University Of Denver College Of Law.
The intense study and work of law school came and went. When law school finished I decided I would open my own law Firm. I had always dreamed of owning my own business and now I had a marketable skill that gave me the confidence to begin realizing my dream. Upon passing the bar I was admitted to practice law and was in business for myself.
At first I began working on estate planning matters. Shortly after, I received a call from a friend who was practicing bankruptcy. We went to lunch and he told me about his practice and I was intrigued by the financial aspects as well as the capacity to help people in Court.
I placed a small bankruptcy advertisement in the free TV Directory of the local newspaper. The first bankruptcy client that filed with us, Anthony, had a host of problems, but his main concern was that he had placed his entire savings as a down payment on a car a few months earlier and the car had been repossessed.
Anthony was extremely distressed when he called. The repossession had only happened a few hours earlier and he was about to lose the $14,000 down payment he had made. This situation was rare, as his vehicle had substantial value and he was about to lose all of it. He did not know what to do; he had spotted our advertisement, and called for help.
I researched the law and came up with a solution. Anthony could get his car back through a Chapter 13 Bankruptcy. I immediately filed an emergency Chapter 13 and contacted the Creditor’s attorney to negotiate the return of the vehicle. The negotiation did not work out as planned. The Creditor’s attorney was unwilling to release the vehicle. Unknown to me, the attorney was notorious throughout Colorado for taking a hard line on turning over vehicles.
I was not going to back down — Anthony needed legal help. I knew I had to come up with a new strategy and course of action to help him. I drafted a complaint requesting the vehicle be turned over and damages be paid by the Creditor for holding the property in violation of the bankruptcy laws. Shortly before the hearing, I received a call from the Creditor’s attorney informing me he had just learned that a week earlier the Creditor had sold the car at auction. This was a blatant violation of the federal bankruptcy laws.
The hearing was approaching quickly and the Creditor’s attorney did not want the case to go to trial due to the serious nature of his client’s violations. I negotiated an agreement between Anthony and the Creditor requiring the Creditor to pay Anthony for the damages he had suffered in losing the car. The agreement allowed Anthony to pay his attorney fees and dismiss the bankruptcy.
The continued pursuit of Anthony’s goal made it so he no longer needed the protection of the bankruptcy laws, and did not lose the money he had saved and used for his down payment.
As the business grew, time passed, and more people like Anthony came for help. In the fall of 2005 bankruptcy laws changed and bankruptcy filings slowed. The law Firm experienced significant loses. This financial drought lasted for almost 2 years.
This was an important time for me. I didn’t sleep and at one point had such a severe reaction to the stress that I had to be taken to the emergency room. During this time I was given the opportunity to reflect on the anguish of being in an oppressive financial situation and this served to strengthen my passion to help others experiencing similar problems. I continued to invest in myself despite the pressure from my debt and I became even more passionate about upholding the rights of people in stressful financial situations.
Since then I have expanded our services to offer professionally designed and custom tailored legal services in more areas of law related to debt. I changed my role to working on the business and carefully found and hired people who are compassionate and provide a human touch to the Client experience.
Dedication, perseverance, compassion, human touch, and the willingness to take action have propelled this company to its present success. As the business continues to grow, more people will be involved, and their experiences as well as mine will continue to add to this company.
